The Case of Giving the Finger

Just the tip of the ice berg

Within Wendy’s Form 10-K for the fiscal year ended January 3, 2021, dated March 3, 2021, their relatively new management (the change in 10-K format one indicator) lists “Item 1A” (page 15) as the all important list of “Risk Factors.” Listed just after the listing entitled “Risks Related to Supply Chain and Labor” and just before the listing “Risks Related to Our Indebtedness” management puts its finger on IT, “Risks Related to Technology and Cybersecurity” as shown in the following statement fragment (page 24):

An increasing amount of our sales and revenues is derived from digital orders, which includes online ordering and delivery. We have implemented technology and targeted advertising and promotions to support the growth of our digital business. If we are unable to continue to grow our digital business, it may be difficult for us to achieve our planned sales growth. If our digital commerce platforms, including the Wendy’s mobile app and online ordering system, do not meet customers’ expectations in terms of security, speed, attractiveness or ease of use, customers may be less inclined to return to those platforms, which could negatively impact our business, results of operations and financial condition. Our business could also be negatively impacted if we are unable to successfully implement or execute other consumer-facing digital initiatives, such as curbside pick-up and mobile carryout. We rely on third-party delivery services to fulfill delivery orders, and errors or failures by those providers to make timely deliveries could cause customers to stop ordering from us. The third-party restaurant delivery business is intensely competitive, with a number of companies competing for capital, market share, online traffic and delivery drivers. If the third-party delivery services that we utilize cease or curtail their operations, increase their fees or give greater priority or promotions on their platforms to our competitors, our delivery business and our sales may be negatively impacted. If we are unable to successfully respond to the challenges arising from our increased reliance on our digital business, this could have a material adverse impact on our brand, business, results of operations and financial condition.

We are heavily dependent on computer systems and information technology and any material failure, misuse, interruption or breach of our systems or technology could adversely affect our business, results of operations and financial condition.

Win, WEN, Wynn, when (no, not making fun of stutterers) I lived in Las Vegas, speaking of putting a finger on it, there was a Wendy’s restaurant residing cozy alongside a small rustic truck-stop at the nearest major intersection just around the corner from my home. I began patronizing this arid and gritty little fueling station regularly to fill up on the illegal contraband, petrol. Today, I see that the petrol part of the stop has been totally removed, while the atypical Wendy’s restaurant structure still remains unchanged including its roomy parking lot. A nod to core competency, space. Since Covid 1919, restaurateurs have had to be more dependent on that competency as well.

In reminescing back to those days, I came across a story that was mentioned on the news after returning to California. The story was about a woman, no not Wendy, her name was Anna Alaya. Yeah, that girl.

[Sixteen years ago to this day], on March 22, 2005, Ayala alleged that she had found a severed human finger in her chili and sued Wendy's, a fast-food restaurant chain. After an investigation by the Santa Clara County Medical Examiner's Office and the San Jose Police Department, it was determined that the finger did not come from a Wendy's employee, or from any employee at the facilities that provided ingredients in the chili. Though early reports suggested that the finger was "fully cooked," the Santa Clara County coroner's office initially concluded that the finger "was not consistent with an object that had been cooked in chili at 170 degrees for three hours."

Hold on now, this story can get really thick and creamy, and may cause brain (Brian) freeze (police), like my favorite frosty (chocolate, of course). So pay attention to the linguistics.


Linguistics is the scientific study of language. It involves analysis of language form, language meaning, and language in context, as well as an analysis of the social, cultural, historical, and political factors that influence language.

Linguists traditionally analyse human language by observing the relationship between sound and meaning. Meaning can be studied in its directly spoken or written form through the field of semantics, as well as in its indirect forms through the discipline of pragmatics (such as from body language and gestures, for instance). Each speech sound particle is called a phoneme. How these phonemes are organised to convey meaning depends on various linguistic patterns and structures that theoretical linguists describe and analyse.

However, this case went down in a San Jose (silly con valley) Wendy's restaurant not my beloved Wendy's of Las Vegas. But Anna lived in Las Vegas, so the Las Vegas Metropolitan police (Metro) got involved. And apparently, Anna tried to sue the franchise. In the end, she spent serveral years in a California prison for fraud and for costing the Wendy's franchise 2.5 million dollars, thank you doctor evil. Meanwhile (Colbert),


On May 13, 2005, police announced that they had identified the finger as belonging to Brian Paul Rossiter, an associate of Ayala's husband. Rossiter had lost his finger in an industrial accident at an asphalt company in December 2004 and had subsequently sold the finger to Ayala's husband in order to settle a debt.

Ok, Sir Ahmed Salman Rushdie, this is a watershed (side note):

March 22, 2021, a mass shooting occurred at a King Soopers supermarket in Boulder, Colorado, United States. Ten people were killed, including a local police officer. Several other officers were injured. The alleged shooter, Ahmad Al Aliwi Al-Issa, was wounded by police.

This strange connection to the Peterson case and satanic culture may be deeper than one thinks. However, it is obvious that the fraudulent case is based on the name "Wendy's" and its homophone "windy." And also "chili" and its homophone "chilly." Resulting in sticking the finger in the chili to test the temperature (or blowing on hot soup - in this case cold chili). These language contexts resolve to the term "Wind Chill Factor."

Unknown to Wendy's at the time, but manifested in the 2018 businessinsider.com article, "Wendy's and McDonald's fought it out in a beefy battle that marked the biggest feud in fast food in 2018", the "wind chill" became a major "factor." In a Super Bowl commercial, Wendy's even mentions that, "the iceberg that sank the Titanic was frozen, too." McDonald's was freezing or receiving frozen meat patties (which goes against the idea of "quality"). It has been said that McDonald's has since ceased its "Where's the beef?" It's "in the freezer" practices.

Apparently, Anna Ayala was experiencing religious insight. Although, the police might say that the only thing religous about her was fraud. Which, oddly, are the usual claims made by none believers. Yet, Wendy's early 10-K filing carried no "vision" statements. And now, Wendy's current 10-K filing vision statement reads "...to become the world’s most thriving and beloved restaurant brand."

Happy beloved ending right? Odd?

The hackers accessed at least one of SolarWinds’ Office 365 accounts by December 2019, and then leapfrogged to other Office 365 accounts used by the company, CEO Sudhakar Ramakrishna said. “Some email accounts were compromised. That led them to compromise other email accounts and as a result our broader [Office] 365 environment was compromised,” he said. One possibility is that the hackers may have compromised the company’s Office 365 accounts even earlier and then used that as the initial point of entry into the company, although that is one of several theories being pursued, Mr. Ramakrishna said. December 2019? That's when Covid 1919 hit.Trust the science? What's a solar wind (Solar Winds - I don't think they have an about page) anyway? It was said to be the biggest event in technology to hit in 2020 and is called the SolarWinds Orion security breach a.k.a. SUNBURST, like Covid. And, the security firm FireEye discovered the hacker activity, like Trump. Well, we see the virus. But what about the finger, where's the finger? Right here, digital. And hot chili, baby.

OK, break it down forniakidd. "The solar wind is a stream of charged particles released from the upper atmosphere of the Sun, called the corona." Get the "upper" atmosphere, and the corona, like corona virus. Well, at the time, "The SolarWinds Orion breach surfaced during a time of transition at the company. Indeed a planned CEO transition from Kevin Thompson to Sudhakar Ramakrishna occurred on January 4, 2021." reports Channele2e. It doesn't get more much more upper than the CEO. Speaking of CEO, did you know that the CEO of Wendy's, food restaurant not of the weather, was Dave Thomas?

Dave Thomas became the popular and human face of Wendy's through the 80's. Also, seen in the movie, Bionic Ever After?, "Dave Thomas (uncredited) appears as one of the hostages held in the embassy basement..." wikipedia; Bionic Ever After?. Of course, this movie was about the popular and romantic bionic duo Steve Austin (Lee Majors) and Jamie Sommers (Lindsay Wagner). But Dave, held in the basement? That's low level. And the systems of both bionic heroes breakdown during the movie. I mean actually in the movie! But these breakdowns play a small role in the movie, like Dave’s cameo. That’s what a cameo is a small role. It’s also “a piece of jewelry, typically oval in shape, consisting of a portrait in profile carved in relief on a background of a different color. “ Google “cameo.” And oddly, Dave did not mention regret for not using Wendy’s profile as cameo for the company’s logo. He probably did not want to have to animate the wind through her hair.

Anyway, back to SolarWinds, which, incredibly, is located in Austin, Texas. Yes, “Bionic Ever After” means they got married. It’s big! And that brings us to the big SolarWinds Orion breach aka Sunburst. Whew! I’m winded! Wet my finger and test the wind direction.



SolarWinds Inc. is an American company that develops software for businesses to help manage their networks, systems, and information technology infrastructure. It is headquartered in Austin, Texas, with sales and product development offices in a number of locations in the United States and several other countries. The company was publicly traded from May 2009 until the end of 2015, and again from October 2018. It has also acquired a number of other companies, some of which it still operates under their original names, including Pingdom, Papertrail and Loggly. It had about 300,000 customers as of December 2020, including nearly all Fortune 500 companies and numerous federal agencies.

A SolarWinds product, Orion, used by about 33,000 public and private sector customers, was the focus of a large-scale attack disclosed in December 2020. The attack persisted undetected for months in 2020, and additional details about the breadth and depth of compromised systems continued to surface after the initial disclosure. In February 2021, Microsoft President Brad Smith said that it was “the largest and most sophisticated attack the world has ever seen". Trump would say "the likes of which have not been seen before." He would know, he was there.

Can you imagine, after all those months nobody caught a body coming through the rye, until the final lip smacking finger? Well that's how it went down (pardon the pun) in Austin. The entire body of work was prepared, the finger was inserted into the mothership, which allowed it to tickle down to all the baby ships. This is classic science fiction movie. Office 365 accounts were accessed, a symbol of circumnavigating the sun (not just the globe). "...then used that as the initial point of entry into the company..." The Wall Street Journal To get to me, you have to go through the sun, solar wind.

FireEye discovered SolarWinds was attacked: During a FireEye breach investigation, FireEye discovered that SolarWinds Orion updates had been corrupted and weaponized by hackers. They reached for countermeasures and their bionics shut down, just like in the movie. What the finger, shields are down. Like Wendy's, I assume both FireEye and SolarWinds are heavily dependent on their digital assets. Like most of us. Meanwhile, all of the stakeholders had to scramble to clean up the solar mess.

And that is odd because Orion is the namesake for a celestial constellation. It generally is only noticeable at night, with the naked eye. Which may be why the Sunburst was not detected by these celestial beings, and of course you were not supposed to look directly at it. Which is why execution ceased for certain addresses. Yet, it being the Hunter constellation required hunting for the threat actor aka the active finger. Not like Anna, who fingered herself.

Anyway, this may not only have caused terrible problems and sleepless nights for Trump, but may also have caused a Hunter Biden stumble. Investigations are continuing, and I suspect those pesky reporters and those rotten kids in Congress will get away with it again. Unless, some brave soul comes forward and fingers this hot potato before topping it with penetrant chili (psst... hey Russia, if you have the 33,000...).
